Terms and Conditions

JOINING MR BIG TOPS

 

* Joining Mr Big Tops, enrolments and orders are subject to acceptance. We reserve the right to cancel your membership at anytime if it becomes apparent that, in our opinion, the postal service in your area is too unreliable.

* If you move house or change address, you must notify us immediately to ensure that no order is sent out to the wrong address, We will not be held responsible for any order sent to the wrong address.

* Upon joining us and supplying us with your telephone number, you give us permission to contact you with regards to your account.

 

GUARANTEE

 

* Due to the nature of the manufacture of our Sweets, we can not guarantee that they are free from traces of nuts, free from gelatine, free of whey powder, cocoa powder, pork gelatine only and certain ‘E’ numbers. We are sorry for any inconvenience this may cause.

* We do our best to ensure that all the Sweets are sent out in perfect condition. We cannot accept responsibility for the climatic conditions experienced once the Sweets have been dispatched e.g. Chocolate melting when exposed to heat.

* The Sweet ingredients list on the website may change slightly from time to time, hence we cannot guarantee that the ingredients list displayed is exact. We do our very best to keep it up to date, but contact us if you require up to date ingredient information.

 

DELIVERY

 

* Delivery can only be sent to addresses within the UK and Northern Ireland only.

* All sweets are carefully hand picked & packaged accordingly.

* Delivery is made via Royal-Mail which we think provides the best service at a reasonable cost.

* We cannot guarantee that your order will fit through your letter box.

* Delivery times may vary depending on your address and circumstances impacting Royal-Mail e.g Snow etc. We will not be held responsible for delays outside our control.

* Please allow up to 5 working days before contacting us about missing orders.

* All our sweets are hand packed with love and care. We are all human here and sometimes honest mistakes happen. We cannot be held responsible for any minor mistakes during packing. Refer to our refund and cancellation policy below.

* We try and make all the packaging as sustainable as we can.

* Boxes are delivered by your local postie. Actual delivery times may vary for you depending on:

A)    our stock availability;

B)    your delivery address;

C)    when you make your selection; and

D)    circumstances impacting delivery by the postage service.

* We reserve the right to use alternative delivery methods without prior notification.

  • You will not hold us responsible for any delays, outside our control, which relate to the delivery of your order.
  • It is your responsibility to report all lost or undelivered boxes online within 7 days.

 

RETURN, REFUND & CANCELLATION POLICY

* If you are not completely satisfied with our product, then please notify us within 7 days, you must return your full Sweet Box recorded delivery within 7 days to Mr Big Tops Sweets, 5 Drake Fold, Wyke, Bradford, BD12 9NU, please enclose your contact details, order number and the details of the problem and the product will be inspected. If the fault is agreed, a full refund will be given for the returned goods. Nothing in this section affects your legal rights.

* We cannot issue refunds if your sweets have been consumed.

 

DATA PROTECTION

 

* We store and process customer data in accordance with the current legal requirements of the Data Protection Act. We will only use customer information to simplify regular log in to our site.

 

STATUTORY RIGHTS

 

·         The Terms and Conditions do not affect your Statutory Rights.

 

FREE OR DISCOUNTED OFFERES

 

* Free or discounted introductory offers are only available to new users of the website. Except where expressly stated.

* Except where otherwise stated, free or discounted offers are available only once to any one person.

* Except where otherwise stated, discounts and credits cannot be used in conjunction with any other offers.

* You must have internet access and valid payment details to redeem a free or discounted offer.

* You will be charged the full price for orders after your free or discounted offer. We will continue to bill subscription orders by your chosen payment method for the Mr Big Tops Sweets Ltd service until you cancel scheduled orders*.  *Minimum time periods apply stated in section 3.

 

 

SUBSCRIPTION TERMS AND CONDITIONS

 

1 Commencement of Delivery Subscription

 

 

If we accept your order for a delivery subscription, and you placed your order before 3:00 pm on a business day, your subscription will be sent out the day you placed your order. If you place your order after 3:00 pm or on a day which is not a business day, your subscription will be sent out as soon as the next business day that you place your order.

 

 

2 DELIVERY

  • You will not hold us responsible for any delays, outside our control, which relate to the delivery of boxes.
  • It is your responsibility to report all lost or undelivered boxes online within 7 days to Royal Mail &help@mrbigtops.com.
  • Customers are obliged to comply with either Royal Mail's claim compensation process. Failure to comply with these processes, as amended from time to time, will result in no credit being made in respect of such undelivered boxes.

 

 

3 SUBSCRIPTION PERIOD

 

 

Once you have placed an order for a subscription, the subscription will continue unless and until it is ended by either of us in accordance with the provisions of section 7 below. Please note that the minimum subscription period is

(a) Twice a week: 1 months (b) Once a week: 1 month (c) Once a fortnight: 1 month (d) Once a month: 2 months

(in each case the "Minimum Subscription Period").

We reserve the right to withdraw or change any subscription and/or price at any time. This will not affect any subscription that you have already paid for.

 

 

4 PAYMENT

 

 

You agree to pay the subscription price for the subscription package you have elected to purchase. You can get details of these prices at www.mrbigtops.com or by emailing our customer services team (see details in section 8 below).

You must provide us with complete and accurate payment information.
Payment for your subscription can be made by:

(i) make payment on a rolling basis and your subscription will automatically continue unless and until terminated in accordance with section 6 below.

For more information on renewal of subscriptions please see section 6 below.

 

 

6 RENEWAL OF SUBSCRIPTION

 

 

If you pay for your subscription on a rolling basis (see section 4 above), there is no need to renew your subscription as it will automatically continue after the Minimum Subscription Period unless and until cancelled in accordance with the provisions of section 7 below. We will continue to take payment by means of your direct debit or credit card (as applicable) at the agreed frequency. If we change the subscription price we will inform you of this with at least 10 working days' notice (or such other length of notice as is required by the Direct Debit guarantee from time to time) so that you can choose whether or not to cancel your payment.

 

 

7 REFUNDS AND CANCELLATION

 

 

Once we have accepted your subscription and payment, your subscription cannot be cancelled until the end of the Minimum Subscription Period.

Cancellation can only be made by emailing our customer service team (see details in section 8 below) or if you placed a subscripton order(s) on our new site after January 2015 you can cancel through you account page after logging in.

We are unable to refund payment unless:

(a)     there are exceptional circumstances, which we will assess on a case by case basis. If we then decid­­e that exceptional circumstances apply we may, at our reasonable discretion, give you a proportionate refund;

(b)     you are not completely satisfied with our product, then please notify us within 7 days, you must return your Sweet Box recorded delivery within 7 days to Mr Big Tops Sweets Ltd, 14 Swann Rd, Coseley, Bilston, WV14 9UP, please enclose your contact details, order number and the details of the problem and the product will be inspected. If the fault is agreed, a full refund will be given for the returned goods. Nothing in this section affects your legal rights.

* We cannot issue refunds or cancel subscriptions if your sweets has been consumed.
